US Court Mandates Release of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks lawful basis.
"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.
The case stems from a erroneous deportation to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to face alien smuggling allegations, he was detained in immigration detention.
In her order, the court pointed out that the government does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."
Context of the Case
The legal challenge center on disputed assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.
He has also pleaded not guilty to the smuggling counts, which are part of a separate trial in Tennessee.
